What is a Commercial EPC?

Similar to Domestic EPCs, a commercial (or non-domestic) EPC provides a rating based on how energy efficient a property is. The rating goes from A to G, with A being the most efficient.
This energy certificate can only be awarded by an accredited company, to ensure total accuracy of the rating available to potential tenants.

Who needs one?

Any landlord who has a property to rent or sell for commercial use is required to have a valid commercial EPC. It is actually a legal requirement for all landlords to get an EPC carried out on their property before it is put on the market. The reason for this is in case, for whatever reason, your property does not meet energy efficient standards – in which case it will need to be improved based on the findings, and then re-assessed before a tenant can start trading from their building.

Penalties for not having an EPC.

Failure to make available an EPC when required by the Regulations means you may be liable to a civil penalty charge notice. The penalty for failing to make an EPC available to any prospective buyer or tenant when selling or letting non-dwellings is fixed, in most cases, at 12.5 per cent of the rateable value of the building, with a default penalty of £750 where the formula cannot be applied. The range of penalties under this formula are set with a minimum of £500 and capped at a maximum of £5,000.

A further penalty can be issued for failure to provide a copy of the EPC when requested to an officer of an enforcement authority within seven days. This is fixed at £200.

It is the duty of every person with an interest in, or in occupation of, the building to cooperate with any seller or prospective landlord as far as is necessary to enable them to comply with any duty under the regulations to make available an EPC, and allow access to any energy assessor they appoint.
